This Terms of Use (“Agreement”) is entered into between you (“you” or “the Guardian”) and wangzz (“we”, “us”, “our”) regarding your use and the use of the child under your guardianship of LearnEnglish (the “App”). Because the App is directed to children aged 3-5, this Agreement must be accepted by the Guardian on the child’s behalf. Please read this Agreement carefully before allowing a child to use the App.

1. About the App

LearnEnglish is an English-learning app for children aged 3-5, offering letter recognition, phonics, word repetition, and short-sentence practice. All core learning data is stored locally on the device; no account registration is required.

2. Guardian Responsibilities

2.1 The App is directed to children, but all legal acts (acceptance of this Agreement, subscription purchases, permission grants) must be performed by the Guardian.

4.1 All content in the App (including but not limited to source code, UI design, illustrations, audio/video assets, alphabet and vocabulary content) is the intellectual property of us or our licensors.

4.2 We grant you a personal, non-commercial, non-transferable, revocable license to use such content solely within the App.

4.3 Third-party assets referenced (including SF Symbols and Apple system fonts) are used under their original licenses; see in-app Settings → Acknowledgements.

5. Fees and Subscriptions

5.1 Some features (premium learning content, ad removal, full progress sync) require a paid subscription. See in-app Settings → Subscription and the Subscription Terms for plans, prices, and renewal rules.

5.2 All purchases, renewals, and refunds are processed by Apple via your Apple ID; we cannot process refunds directly. Please request refunds via https://reportaproblem.apple.com.

5.3 Subscriptions are purchased by the Guardian; a Parental Gate must be passed before purchase.

6. Disclaimer

6.1 The App is provided “as is”. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, error-free operation, and uninterrupted availability.

6.2 The App’s educational content does not replace professional in-person teaching; we do not guarantee any specific learning outcomes from using the App.

6.3 We are not liable for service interruptions or data loss caused by force majeure (including Apple service outages, network failures, natural disasters, user device failures). For free portions of the App we have no liability; for paid subscriptions, our liability cap is described in Section 8 of the Subscription Terms.

7. Limitation of Liability

To the maximum extent permitted by law, our total liability to you shall not exceed the subscription fees you have actually paid in the 12 months preceding the claim.

8. Changes and Termination

8.1 We may update this Agreement as the product evolves or as required by law. Updated versions will be published in the GitHub md-doc repository and the Guardian will be asked to reconfirm on the App’s next launch. Material changes will be communicated via in-app notice.

8.2 You may terminate this Agreement at any time by uninstalling the App. Uninstall removes all local learning data; for Apple-managed subscriptions, see Section 3 of the Subscription Terms for cancellation.

9. Governing Law and Disputes

This Agreement is governed by the laws of the People’s Republic of China. Disputes shall first be resolved through friendly negotiation; failing that, either party may file suit in the people’s court with jurisdiction at our domicile.
